Kuna aina Mbili za usitishwaji wa ajira ambazo ni,
(i) Usitishwaji wa ajira kwa Haki
(ii) Usitishwaji wa ajira pasipokuwa na haki?

(a)Kutoa Siri za Ofisi yake afanyiayo Kazi na Shughuli Zake.
(b)Kuthibitika amefanya Wizi kwenye mali ya mwajiri wake. Hivyo kukutwa na kosa la jinai, pia lazima ithibitishwe akiwa ametenda kosa hilo.
(c) Utovu wa nidhamu mahali/sehemu ya kazi.
(d) Utoro kazini kwa zaidi ya siku tatu.
(e) Kushindwa kutunza kumbukumbu za ofisi.
JIBU
(a) kuondolewa/kusitishwa kwenye ajira bila kupewa onyo kulingana na kosa alilotenda muajiriwa.
(b) Kusitishwa kwenye ajira bila kupewa sababu za msingi za usitishwaji wa ajira.
(c) Kusitishwa kwenye ajira bila kupewa nafasi ya kujitetea kulingana na kosa alilolifanya mfanyakazi/mwajiriwa.

Stahiki ambazo anastahili kuzipata mwajiriwa baada ya kusitishiwa ajira yake pasipo haki ni Kama zifuatazo:
(a) Kulipwa fidia ya mishahara yake isiyopungua miezi kumi na mbili (12)
(b) Kurejeshwa kwenye ajira na kulipwa mishahara bila kuwapo na hasara Kwa kipindi ambacho mwajiriwa hakuwepo kazini kutokana na kusitishwa kwa ajira bila kufata haki.
